RENTAL AGREEMENT

SEASONAL FURNISHED LEASE – PATCHWORK APARTMENT

Preamble

This agreement defines the terms and conditions for the rental of the furnished apartment designated in the reservation email, between the Tenant, on the one hand, and Hôtel et Chalets Patchwork, a limited liability company (SARL) with a share capital of €8,000, whose registered office is located Rue des Grandes Alpes, 73450 Valloire, France, registered with the Chambéry Trade and Companies Register under number 518 452 032, represented by Mr. Yves PEIS, acting in his capacity as Managing Director, hereinafter referred to as “the Landlord”, on the other hand.

The purpose of this agreement is to define the conditions of reservation and stay, under a seasonal rental arrangement, for this furnished apartment, the descriptive sheet of which is attached hereto.

This rental is granted exclusively as temporary and leisure accommodation and is governed by the provisions of the French Civil Code and the specific terms set out herein.
Under no circumstances may the Tenant establish the premises as a primary or secondary residence, nor conduct any commercial, artisanal, or professional activity therein.

The relationship between the Landlord and the Tenant is based on trust. The Tenant undertakes to respect the rented property and to return it in good condition.

The Tenant may not, under any circumstances, claim any right to remain in the premises upon expiration of the rental period specified in this agreement, except with the express consent of the Landlord.

The Landlord rents, for the period specified below, the premises described hereinafter, furnished and equipped as detailed below and in the attached inventory, to the Tenant, who accepts them under the following conditions.

ARTICLE 1 – DESCRIPTION

1.3 – Amenities and services provided

Household linen:
Bed linen, towels, and kitchen towels are provided only if this option has been selected in your booking confirmation. Otherwise, guests must bring their own linen or notify us at least 72 hours prior to arrival to add this option.

Parking:
One parking space per apartment is provided free of charge for the duration of the stay, except for apartments A01, B31, C21, and C22, which benefit from two parking spaces. Most parking spaces are located in the underground garage (some remain outdoors). Please note that height restrictions may prevent access for taller vehicles or vehicles equipped with ski boxes. As parking spaces are provided free of charge, they may not give rise to any claim or constitute grounds for cancellation should they prove unsuitable.

Cleaning:
End-of-stay cleaning is mandatory and carried out by our staff to ensure optimal comfort and hygiene for subsequent guests. The cleaning fee is mandatory and inseparable from the rental price.

Swimming pool / Sauna / Hammam:
Access to the heated swimming pool, sauna, and hammam located in the basement and accessible directly by elevator is available as a paid option, calculated based on the number of occupants and the duration of the stay. The wellness area is open from June 20 to August 31 during the summer season and throughout the winter season.
This option must be booked at least 48 hours prior to arrival and applies to all occupants for the entire stay, including children aged 2 and over.
The wellness area may be closed during low season, for sanitary or hygiene reasons (including pandemics), or temporarily for maintenance. In such cases, guests will be refunded on a pro-rata basis for unused days. Under no circumstances shall the closure of these facilities constitute grounds for cancellation of the accommodation.

ARTICLE 2 – INVENTORY AND CONDITION REPORT

An inventory of furniture and equipment is made available in the apartment for the Tenant to verify upon arrival.

Any claim regarding the rented property, and in particular the inventory, must be reported to the Landlord within 48 hours following key handover. No claims will be accepted after this period or after departure.

Any item moved from one apartment to another and not returned to its original location will be considered missing.

In the event of lost keys, a flat fee of €60 will be charged for replacement of the lock cylinder (apartment and/or ski locker), or €15 per lost key.

ARTICLE 3 – USE OF THE PREMISES

The premises are rented exclusively for residential use as seasonal accommodation.

ARTICLE 4 – TERM OF THE AGREEMENT

This agreement is concluded for the duration specified in the booking confirmation.
Check-in is from 5:00 p.m., and departure must take place no later than 10:00 a.m.

Early check-in from 12:00 p.m. is available subject to the “Early Arrival” option and must be requested at least one week prior to arrival.

Under no circumstances may the rental period be extended without the prior written consent of the Landlord.
In any event, the total duration of the initial and any extended rental may not exceed 90 days.

ARTICLE 5 – RENTAL PRICE AND CHARGES

5.1 – Rent and included charges

The rental price stated in the booking confirmation (VAT included at 10%) covers:

  • occupancy of the premises

  • electricity consumption (including heating)

  • cold and hot water consumption

  • tourist tax

  • household linen (if selected)

  • Wi-Fi internet access

  • end-of-stay cleaning

Any additional services not listed above are charged as optional services at a VAT rate of 20%.

The rent is subject to VAT pursuant to Article 293 F of the French General Tax Code, the Landlord having expressly opted for VAT liability.

A detailed invoice indicating rent and applicable VAT will be issued by the Landlord.

5.2 – Payment terms

If booked via chalets-valloire.fr:

Flexible rates:

  • 40% deposit if booked more than 30 days prior to arrival

  • Balance charged 30 days prior to arrival

  • 100% payment if booked less than 30 days before arrival

Non-refundable rates:

  • 100% payment at time of booking

If booked via a third-party platform (Airbnb, Booking, Abritel), the platform’s payment terms prevail.

ARTICLE 6 – SECURITY DEPOSIT

A security deposit is required no later than the day of key handover, via pre-authorization or bank card imprint.

Deposit amounts vary by apartment category (as listed in the French version).

The deposit bears no interest and will be returned after deduction of any damages, missing items, additional cleaning, or unpaid charges.

ARTICLE 7 – TENANT’S OBLIGATIONS

The Tenant undertakes in particular to:

  • take possession of the premises in the condition described

  • use the premises peacefully and for their intended purpose

  • refrain from smoking indoors

  • be liable for any damage or loss caused during the stay

  • use furniture and equipment properly and not remove them

  • refrain from modifying the premises or furniture layout

  • not sublet or transfer the lease

  • respect occupancy limits

  • introduce no animals

  • report any damage or malfunction without delay

Failure to respect check-out time will result in a late departure fee of €20 per additional hour.

ARTICLE 8 – LANDLORD’S OBLIGATIONS

The Landlord undertakes to:

  • provide accommodation consistent with its description

  • ensure peaceful enjoyment of the premises

  • provide equivalent or superior accommodation if necessary, without compensation

The swimming pool complies with legal safety standards. The Landlord shall not be liable for accidents involving children left unsupervised.

ARTICLE 9 – INSURANCE

The Tenant must take out insurance covering fire, theft, water damage, and third-party liability and provide proof upon arrival. Failure to do so will result in immediate termination of the agreement.

ARTICLE 10 – TERMINATION CLAUSE

Failure to comply with contractual obligations or payment terms shall result in immediate termination after formal notice, with the Landlord entitled to retain deposits pursuant to Article 1590 of the French Civil Code.

ARTICLE 11 – CANCELLATION CONDITIONS

The Landlord reserves the right to cancel a reservation without compensation in cases of force majeure or for bookings made more than one year in advance, with full refund of amounts paid.

The Landlord also reserves the right to cancel any reservation, without compensation, if the Client has previously caused damage or theft within the establishment. In such cases, the Client may be refused any future reservation in order to protect the property and business operations.

ARTICLE 12 – VALIDITY AND ACCEPTANCE

This agreement is available at all times on https://chalets-valloire.fr and is deemed accepted upon payment of a deposit or the full stay.
